The current Privacy Policy depicts your privacy rights in terms of gathering, use, storing, sharing, and protecting your personal data. You agree to this Privacy Policy by signing up, accessing App or using PowerUpLink Services. If you do not agree, you should stop accessing this App and/or use the Services provided by PowerUpLink immediately and refrain from further access and use of them.
The following definitions will apply in this Privacy Policy:
You, Your refers to any user of this App and Our Services.
We, Us and Our refers to PowerUpLink GmbH or the PowerUpLink’s affiliated parties.
PowerUpLink means PowerUpLink GmbH, a legal entity registered in Germany with registration number HRB 253213.
PowerUpLink affiliated parties refer to PowerUpLink affiliates, subsidiaries and its respective directors, employees, agents and shareholders.
The App refers to the PowerUpLink mobile application SnowTrack including all its content.
Services mean services of providing access to the software solutions, technologies and information which are powered and provided by PowerUpLink to You.
Data means data and/or information submitted by you through the App or by other means to us, including your personal data.
Personal Data means any information, which, either alone or in combination with other information we process about you, identifies you as an individual.

DATA WE MAY COLLECT
PowerUpLink does not intentionally collect any Personal Data. You can access the App and obtain PowerUpLink Services without providing your Personal Data, like name, e-mail, phone number etc.
The only type of information We gather is device Data, particularly:
We can also obtain Your IP-addresses, your location and other web and mobile network data. Such information by itself does not constitute Personal Data and is used to safeguard You from scam, to ensure APP stability and robustness and to improve our Services.
If we obtain Your Personal Data accidentally, we commit to delete it as soon as possible. We do not collect any extra data but only that information that is necessary for providing PowerUpLink Services to you. However, please be aware that the list of information types mentioned above is not exhaustive. Additional information about you might be gathered in some other way, for instance by your contacting our support team.
In case we require Your Personal Data in some specific case, we will contact you to obtain your consent for such use. We warrant to you that if we process your Personal Data We will comply with our obligations as a data controller under the Data Protection Laws.

You should be aware that the processing of your Data is necessary for the performance of a contract with PowerUpLink to which you are the party. The data we collect may be used to:

PROTECTION AND STORAGE OF YOUR DATA
We warrant and represent that we have implemented the technical and organizational security measures and technological development to ensure an appropriate level of security of personal data. Your Data is protected by the means of physical, technical, and administrative resources to lower the risks of loss, misusage, unauthorized entry, disclosure, or alteration by a third party. To keep your data safe we apply firewall and data encryption protection and physical authorization control system, just to name a few. We monitor our systems 24×7 and our staff is always ready to respond to your notifications and queries within a short time.
HOW LONG WE RETAIN YOUR DATA
We may use your Data for as long as reasonably necessary for the limited purpose of providing You access to APP or for the purpose to comply of with technical and legal requirements related to the security, integrity and operation of PowerUpLink Services. After You stop using APP or PowerUpLink Services, you may request deletion of your Data. We are able to delete your Data or information within thirty days.
HOW WE SHARE YOUR DATA WITH THIRD PARTIES
We may engage third-party service providers to work with us to administer and provide the Services. These third-party services providers have access to your Data only for the purpose of providing services on our behalf (such as hosting of the services, data analysis, IT services and infrastructure, customer service and other similar services) and are normally obligated not to disclose or use your Data for any other purpose.
WEB ANALYTICS WITH MATOMO (WITHOUT COOKIES)
Your privacy is our top priority. To analyze and optimize the usage of our App, we use Matomo, a privacy-friendly open-source web analytics software. We operate Matomo without cookies, ensuring that no tracking cookies are stored on your device. All collected data is fully anonymized, preventing any personal identification. Additionally, your IP address is processed in a shortened form. The gathered data remains solely on our own servers and is not shared with third parties. Our objective is to enhance our Services while safeguarding your privacy at all times.
AGE RESTRICTIONS
We do not intentionally collect, use or disclose Personal Data of persons under 18 or younger than equivalent minimum age in your jurisdiction. PowerUpLink Services are not designed to attract minors. If you are under the age of 18 (or the relevant minimum age in your jurisdiction), you must not submit any Personal Data to us or subscribe for our Services. If we become aware that we have obtained the Personal Data of a minor, we will delete it as soon as possible.
THIRD-PARTY SITES
Our App may contain links to third-party websites and features. This Privacy Policy does not cover the privacy practices of such third parties. These third parties have their own privacy policies and we do not accept any responsibility or liability for their websites, features or policies. Please read their privacy policies before you submit any data to them.
DATA BREACHES
We ensure you that we have all the necessary technologies and methods to prevent, detect and investigate a Personal Data breach. In case of any data breach, we will endeavor our best efforts to send you a notification within 72 hours of becoming aware of the breach.
CHANGES TO THIS PRIVACY POLICY
If we make amendments to this Privacy Policy, we will notify you of any substantial changes through the App. You should stop accessing the App or using PowerUpLink Services if you do not agree to any changes. By continuing to use the App or PowerUpLink Services, you accept the changes.
